Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Gigly application or website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our Services. These Terms constitute a legally binding agreement between you and GIGLY NIG LTD.

2. Eligibility

• You must be at least 18 years of age to use Gigly, or 13-17 with verifiable parental or guardian consent.
• You must be a resident of the Federal Republic of Nigeria.
• You must provide accurate, complete, and current information during registration.
• You must not have been previously suspended or banned from Gigly.

3. Account Registration & Security

• One account per person. Creating multiple accounts is prohibited.
• You are responsible for maintaining the confidentiality of your password and PIN.
• You must notify us immediately of any unauthorized account access.
• We reserve the right to suspend accounts that show signs of fraud or abuse.
• Gigly is not liable for losses resulting from unauthorized access due to your failure to secure your credentials.

4. Wallet Funding & Usage

• Your Gigly wallet is a prepaid virtual wallet for purchasing VTU services.
• Wallet funds can be added via bank transfer or card payment through our payment partners.
• Wallet funds are non-transferable between users.
• Gigly does not pay interest on wallet balances.
• Withdrawal of wallet funds may be subject to identity verification requirements.
• We reserve the right to freeze wallets suspected of fraudulent activity pending investigation.

5. VTU Services

• Delivery Timeframe: Data and airtime are typically delivered within 30 seconds. In exceptional cases, delivery may take up to 30 minutes.
• Failed Transactions: If a transaction fails after wallet debit, your wallet will be automatically refunded within 1-3 business days.
• Accuracy: You are solely responsible for entering the correct phone number and selecting the correct network.
• Network Availability: VTU services depend on third-party network operators. We are not liable for network downtime.
• Pricing: Data bundle prices are subject to change without notice based on provider rates.

6. Prohibited Activities

You must not use Gigly to:

• Engage in fraudulent transactions or money laundering.
• Create fake accounts or impersonate other users.
• Resell Gigly services for commercial profit without authorization.
• Attempt to reverse-engineer, hack, or disrupt our platform.
• Use automated scripts or bots to interact with our services.
• Engage in any activity that violates Nigerian law.
• Abuse the referral system or gamification features through fraudulent means.

7. Intellectual Property

All content, branding, logos, interfaces, and code within Gigly are the exclusive property of GIGLY NIG LTD. You may not copy, reproduce, distribute, or create derivative works without our written permission.

8. Limitation of Liability

To the maximum extent permitted by Nigerian law, Gigly shall not be liable for:

• Indirect, incidental, or consequential damages arising from service use.
• Loss of data, revenue, or profits not directly caused by our gross negligence.
• Service interruptions caused by third-party network providers or payment processors.
• Unauthorized account access resulting from user negligence.

Our total liability in any claim shall not exceed the amount you paid us in the 30 days preceding the claim.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria.

10. Dispute Resolution

In the event of a dispute:

1. Contact our support team first at support@gigly.ng.
2. If unresolved within 14 days, disputes shall be referred to mediation in 1,Beside General Hospital, Ankpa, Kogi State, Nigeria.
3. If mediation fails, disputes shall be resolved by arbitration under Nigerian law.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account yourself at any time in the app, under Settings → Delete Account, or by emailing support@gigly.ng. Deleting your account does not forfeit your wallet balance — if you have funds remaining, our support team will contact you to arrange payment. No fee is deducted.
